1. Interpretations

The following terms as used in the General Conditions shall be having the following meanings: 

1. 1. All tour and travel arrangements being booked, either in a package or as separate items, with Wild Spirit Productions Pvt. Ltd.

   2. Client, participant, you, your, all of which refer to the person booking a Tour with Wild Spirit Productions Pvt. Ltd. and those on whose behalf he/she has signed for. 

2. Booking

1. Booking a Tour with Wild Spirit Productions Pvt. Ltd. requires the signing of the General Conditions, along with a complete Form and the payment of a Booking amount as Tour Itinerary.

2. The balance of the Tour price is due not later than 12 Weeks prior to departure, unless otherwise specified. If the booking is made within 60 (sixty) days of departure, then full payment of the Tour price is required.

3. Provisional booking requests are accepted by email or phone. Following your request, we will send you the General Conditions, and the Invoice for payment of deposit. If the signed General Conditions, including the completed Booking Form, and the deposit are not received within 14 (fourteen) days, the provisional booking will be automatically cancelled.

4. Items included in and excluded from the Tour price are specified in the Tour Programme attached to the Invoice.

5. Kindly note that the payment of the deposit or any other partial payment for a Tour with Wild Spirit Productions Pvt. Ltd. constitutes consent by the Client and all persons covered by that payment to the Booking Terms and Conditions and the Disclaimer & Assumption of Risk.

 

1. Cancellation and refund policy

   1. Cancellation is only effective upon Wild Spirit Productions Pvt. Ltd. receipt of written notification by the Client.

   2. If cancellation is made earlier than 6 (six) months before departure, the deposit will be entirely refunded, minus bank charges (that is the Client will bear bank charges).

   3. If cancellation is made within 6 (six) months to 61 (sixty one) days before departure, the deposit will not be refunded. Any additional payment already made will be refunded, minus bank charges (that is the Client will bear bank charges).

   4. If cancellation is made within 90 (sixty) days or less before departure, the deposit and any additional payment already made will not be refunded. If cancellation is due to proven extenuating circumstances beyond your control, we will present your case to our suppliers for their consideration. Please note that any partial refund, if applicable, will be solely to the discretion of our suppliers and made minus bank charges (that is the Client will bear bank charges). If the Client fails to join a Tour without prior notification (no show) or join it after departure or leave it prior to its completion, no refund will be made for the Tour price paid or any unused portions of the Tour. 

   5. If the Client fails to pay the balance of the Tour price when due, the booking is deemed to be cancelled. In this case the deposit and any additional payment will not be refunded.

 

1. Cancellation due to force majeure

1. In case of “force majeure” events, Wild Spirit Productions Pvt. Ltd. will reserve the right to cancel or curtail the Tour. Force majeure events refer to any exceptional events which Wild Spirit Productions Pvt. Ltd. has no control over and that cannot be foreseen, prevented or solved even in circumstances where all due diligence and care is taken. These include, but are not limited to, war, threat of war, riot, civil strife, terrorist activity, acts of government, natural disaster, forces of nature, epidemic, pandemic and any other cause whatsoever, whether the risk is real or perceived, that make operation of the Tour impossible, illegal or inadvisable.

2. In case of Tour cancellation or curtailment due to force majeure, all Tour payments received (deposit and additional payments) will not be refunded.

3. In such case, Wild Spirit Productions Pvt. Ltd. cannot accept any liability or pay any compensation in respect to any inconvenience suffered by the Client, or any expenses incurred by the Client in preparing for the Tour, including non-refundable or penalty-carrying international airline tickets, special clothing and gear, visas, passport fees, other travel documents and Tour-related expenses.

1. Mentor change

1. In case that a guide who is specifically chosen or nominated at the time of booking becomes unable to lead a scheduled Tour due to illness, injury, or extenuating circumstances beyond personal control, Wild Spirit Productions Pvt. Ltd. reserves the right to either substitute the guide with another guide or transfer the Tour package to a reputable tour operator.

2. If the total price of the Tour with the new guide or after transfer to a tour operator is lower than the price already paid, Wild Spirit Productions Pvt. Ltd. will fully refund the difference. The Client will bear bank charges (that is we will bear bank charges). This refund will be the limit of Wild Spirit Productions Pvt. Ltd. liability.

1. Passports, visas, vaccinations and other travel documents 

1. It is the Clients’ responsibility to fully acquaint themselves with any necessary passports, visas, vaccination certificates and other travel documents requirements such as, but not limited to, medical certificates and medication prescriptions, for the countries they plan to visit.

2. The onus is upon the Clients to ensure that the above mentioned documents are obtained and valid for the countries they plan to visit. Wild Spirit Productions Pvt. Ltd. may offer advice on such matters, but cannot be held liable for any passports, visas, vaccination certificates and any other travel documents, which are invalid or not held by the Clients, nor for the cost of obtaining them or delaying/cancelling the Tour as a consequence of this.

 

1. Client representation and consent

1. The Client making a booking with Wild Spirit Productions Pvt. Ltd., warrants that he/she has authority to sign the General Conditions on behalf of all other persons included in the Booking Form and that he has confirmed the validity of their personal details.

2. The Client warrants that all other persons included in the Booking, on whose behalf he/she is making the booking, have acknowledged, understood and accepted the General Conditions.

3. In the event of the failure of any or all of the other persons so included to make payment, the Client making the booking shall by his/her signature thereof assume personal liability for the total price of all bookings and penalties, if any.

DISCLAIMER & ASSUMPTION OF RISK

 

This section defines the responsibility of Wild Spirit Productions Pvt. Ltd. (which expression includes its successors and assigns, agents, booking agents, associated companies, sub-contractors, associates, employees, directors and other officers) with respect to the Tour booked for the Client (which expression includes his/her/their personal representatives, successors and assigns, all the persons on whose behalf the Client has made the booking, and any accompanying children). Please read it carefully.

1. The Client fully acknowledges, understands and accepts that:-

 

1. Wild Spirit Productions Pvt. Ltd. will take all reasonable care to protect the Client and his/her property during the Tour as well as ensure that the Tour is properly arranged and the Tour programmed is adhered to.

2. Tours to remote and other areas in Africa (including stays in camps, hotels, lodges or other places) and the modes of transportation to reach and visit these places whether by plane, boat, motor vehicle, on foot or the like, involve some inherent risks of illness, injury or death and loss or damage to property which may be caused by acts, omission or negligence of others, forces of nature, wildlife, civil conflict or any other causes.

3. Such risks may be present at any time before, during and after the Tour. The Client is also aware that there may be no means of rapid evacuation and access to adequate medical facilities during the Tour.

4. It is the Client’s responsibility to make certain that he/she is adequately insured in respect of all risks and eventualities.

5. Wild Spirit Productions Pvt. Ltd. does not accept any liability for illness, injury or death to Clients, any loss or damage to Clients’ property, Tour delay, change in the Tour program and any initial Tour agreements, Tour cancellation, or inconvenience suffered by the Client and additional expenses incurred by the Client with regards to, but not limited to, any of the above mentioned eventualities that are caused by any act, omission or negligence of any of the suppliers, or the suppliers’ servants that are used during the Tour, forces of nature, wildlife, civil conflict or any other causes that are beyond the control of Wild Spirit Productions Pvt. Ltd.

6. Wild Spirit Productions Pvt. Ltd. will accept responsibility only to the extent that such eventualities were caused by Wild Spirit Productions Pvt. Ltd.’ willful act or gross negligence.

7. Upon payment of deposit to Wild Spirit Productions Pvt. Ltd., the Client acknowledges that he/she has read and understood the Booking Terms and Conditions and the present Disclaimer & Assumption of Risks and agrees to be bound by them.

1. The Client fully assumes all such risks and hereby releases and discharges Wild Spirit Productions Pvt. Ltd. from all action, claims and demands for damages or compensation or costs.

2. The Client is aware that the Tour will not commence until Wild Spirit Productions Pvt. Ltd. has received the General Conditions, signed and in good order, from all the people named in the Reservation Form.
